If you are making a donation to the Tournament for Hope or Toy Drive and Winter Carnival or Fund for Shane and David Smith, or other Charitable event, Thank You! If you or your child are not directly participating in an Austin Wildcats program or the Tournament for Hope, the Program Participation Waive does not apply to you.

Program Participation Waiver

By agreeing to participate in an Austin Wildcats Basketball, Inc. Program, you agree to the following Terms and Conditions:

Program: I desire for my child to participate in activities provided by the Austin Wildcats Basketball Incorporated (AWBI).

Payment: The fees for our Programs are for the whole program, only. If you have selected to pay using our recurring billing system, note that we are NOT a month to month program. You are agreeing to purchase the whole program. It is not our intent to stop the recurring billing commitment if a player is gone on vacations, camps, or quits the program entirely. If you select the "pay be mail" method, recurring payment option is not available. You must send the payment by check to AUSTIN WILDCATS BASKETBALL, Inc 2105 STONE RIVER DRIVE, AUSTIN, TX 78745. Make checks payable to AUSTIN WILDCATS BASKETBALL, Inc. The full payment is due immediately upon signup.

Risks: I understand the nature of the physical demands of such activities. I understand that the physical demands of such activities, as well as the activities themselves, may result in injury to my child, and that such injury may be severe. I have made AWBI aware of any and all medical and physical conditions that might affect my child's participation. I understand that reasonable procedures are employed by AWBI, but that unforeseen circumstances or accidental events may occur, for which AWBI, its officers, agents, representatives, coaches, volunteers, and employees cannot be held responsible. I hereby assume all ordinary risks normally incidental to the nature of this activity and program, including those risks which are not foreseeable

Release: I unconditionally waive and release the Austin Wildcats Basketball Incorporated (AWBI), its officers, agents, representatives, coaches, volunteers, and employees, and agree to hold said persons harmless from any and all claims, rights, or causes of action which may be asserted against AWBI, its officers, agents, representatives, coaches, volunteers, and employees by any person as the result of any injuries, expenses, loss of compensation, or loss of experience as a direct or indirect result of the use of the services, facilities, instruction, or premises of the Austin Wildcats Basketball Association or as a direct or indirect result of my child's participation, or from any negligence on the part of the Austin Wildcats Basketball Association, including any act or failure to act.

Indemnification: I unconditionally promise and agree to indemnify AWBI and its officers, agents, representatives, coaches, volunteers, and employees and to hold said persons harmless from any and all claims, rights, or causes of action which may be asserted against AWBI, its officers, agents, representatives, coaches, volunteers, and employees by any person as the result of any injuries (regardless of severity), expenses, loss of compensation, or loss of experience as a direct or indirect result of the use of the services, facilities, instructions, or premises of AWBI, or from any negligence on the part of AWBI, including any act or failure to act. This agreement to indemnify includes any and all money paid by AWBI, its officers, agents, representatives, coaches, volunteers, or employees to, or charged by, any person (whether by virtue of a settlement or in litigation), including attorney's fees for any parties to the claim, demand, or litigation.

Consideration: I hereby acknowledge the validity and adequacy of the consideration for this release being the offering and provision of AWBI.

Binding Effect: This agreement is binding upon me and upon my spouse, heirs, assigns, dependents, personal representatives, attorneys, and my estates. This agreement is also binding upon my child or children on whose behalf it is executed and upon any legal guardian thereof.

Entire Agreement: This document constitutes the entire agreement between AWBI and the undersigned regarding the subjects covered hereby. All previous agreements, oral or written, are superseded and there exist no further oral or written representatives, promises, assurances, or statements of any kind affecting this agreement except those which are expressly set forth in this document.

Austin Wildcats Purchase/refund policy:

The fees for our Academy Programs are for the "whole" program, only. Although this year we are giving the parents the option to select recurring billing, we are NOT a month to month program. When you register, you are agreeing to purchase the whole program. It is not our intention to stop the recurring billing commitment if a player is gone on vacations, camps, or quits the program entirely.
